Terms of Service
This document outlines the terms and conditions of use of the BMF NHS Partnership Platform (BMF NHS Platform). These terms and conditions apply from the date you indicate your acceptance during your account registration.

- Use of personal data / contact details
- All email addresses will be passed on to an independent evaluation team who may contact you to ask you to complete an anonymous survey, which will then be analysed by the evaluation team. Please be assured that the surveys are anonymous and that they are optional.
- Your email address will be used to send you information relating to your account, for example password resets or necessary updates to the Service or Terms.
- All email addresses will automatically be added to an automated email distribution list that will only be used for communication from BMF relating only to the BMF NHS Partnership platform and offer. It may include updates on new content, reminders, invitations or other information relating to the offer than may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.
- Your name will only be used for personalisation on the platform or in automated emails to the email address you provided in the registration
- Except for paragraph 1.1 above, we will not process or report any Personal Data within this Service. We will further continually monitor all data processing and reporting to ensure that all data remains non-identifiable.
- Purpose of processing.
Processing of data occurs for the purpose of:
- Evaluating the effectiveness of the service
- Evaluating engagement and retention across all groups
- Evaluating perceived behaviour change across all groups
- To improve the service
- To provide you with a customised health programme
- To aid clinical research into movement, health, wellbeing and behaviour change.
No personal data will be included in this processing and we will continue to monitor the processing and reporting to ensure all data remains non-identifiable.
- Third party processing
We may use third parties to assist in the processing of data that has been collected through this service. These partners have been pre-approved and will only process the data in line with the scope of the services.

- Data security and storage:
We will retain personal data only for as long as is necessary for the purposes set out in these Terms and Conditions and in our Privacy Policy.
All data collected by BMF will be stored in secure hosting facilities provided by Amazon Web Services. BMF has a data processing agreement in place with its provider, ensuring compliance with the directive. All hosting is performed in accordance with the highest security regulations. All transfers of data internally within the EEA is done in accordance with this data processing agreement.

Please be assured that there are no right or wrong answers to any of the questions that are asked or surveys that are requested. We are interested only in your perspectives and your experiences.

- Collection
While using our Service, we may ask you to provide us with certain types of data which are described as:
- Personally identifiable information ("Personal Data"):
This includes your name, email address, date of birth and mobile number.
Please note that date of birth and mobile number are optional to provide.
- Usage data:
We will also collect information on how the Service is accessed and used.
This Usage Data may include information such as your computer's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
- Mandatory registration information:
This includes your NHS Region and Staff Group.
- Optional registration information:
This includes your ethnicity and gender.
- Profile information:
Within the platform, we will be requesting data relating to the topics of the Service for example, your perceived levels of wellbeing, fitness levels and nutritional awareness.
- Feedback or survey data:
We will be requesting feedback data from you on the performance of the platform and the content being provided. This will always be an optional submission and anonymous.
- Platform support data:
Should you encounter an issue with platform, you are invited to submit a support ticket through the platform which would require your name, email address, a description of the issue and any image uploads.
- Use of data
Data that has been collected through the platform will be used and processed in different ways.
- Personal data: Names will only be used to create personalisation on the platform. Emails will only be used for automated email communication.
- To provide and maintain our service
- To notify you about changes to our service
- To allow you to participate in interactive features of our service when you choose to do so
- To provide customer support
- To gather analysis or valuable information so that we can improve our service
- To monitor the usage of our service
- To detect, prevent and addressing technical issues
- To provide you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information
- Health advice and guidance
- Never train when feeling ill or overly fatigued.
- If you have concerns STOP and seek advice from your doctor.
- Ensure you rest and properly recover between sessions.
- Do not train if you’ve consumed alcohol or are feeling the effects of excess consumption.
- Keep a bottle of water with you during sessions and stay hydrated.
- You are responsible for exercising within your limits.
- If at any time you feel you are exercising beyond your current fitness abilities, or you feel discomfort, pain, dizziness, or nausea, you should discontinue exercising immediately. Nothing on the BMF NHS platform constitutes medical or professional advice or care.
- You are responsible for exercising within your limits and assume all risk of injury to your person or property resulting from your use of the BMF NHS platform, except where injury to your person has been caused by our negligence.
Young adult content
The content on this platform is not suitable for use by children under the age of 16
Responsibilities

- Our liability to you:
- We accept liability for death or personal injury caused by our negligence or that of our employees and agents. We do not seek to limit or exclude liability for fraudulent misrepresentation, wilful misconduct or gross negligence by us or our employees or agents or any other liability which cannot be limited or excluded under applicable law.
- If we breach these terms of use we will only be liable for losses which are a reasonably foreseeable consequence of that breach. Losses are foreseeable where they could be contemplated by you and us at the time of you agreeing to these terms of use.
- We are not responsible for:
- Any use of the BMF NHS platform which isn't authorised by us;
- Any malfunction of or interruption to the BMF NHS platform due to unforeseeable circumstances that prevent us from fulfilling our obligations to you;
- Errors, viruses or bugs present in or arising from your use of the BMF NHS platform;
- Incompatibility of the BMF Digital Service with any other software or hardware (including any of your devices); and
- Any act or default of any third party platform, service provider, supplier, device manufacturer or provider of a device operating system, which are beyond our reasonable control.
- Your obligations – you must not, and must not allow third parties, to:
- Attempt to copy, reproduce, publish, transmit, broadcast, archive, download (other than through caching necessary for personal use), distribute, modify, display, perform, license, transfer, exchange, translate, create derivative works from, offer for sale, or use (except as explicitly authorised in this Agreement) content and information contained on or obtained from or through the BMF NHS Platform without express written permission from us.
- Use the Content to teach or instruct any fitness class outside of the NHS or for any commercial or business purpose.
- Make sure everyone you are responsible for and who may use or do anything in relation to the BMF NHS platform also meets the responsibilities set out in these Terms.
Changes to these Terms
We may change these Terms from time to time. The circumstances in which we may change these Terms may include (without limitation), to comply with applicable laws, to provide you with additional information about the BMF Physical Health Offer, where we need to make changes to the BMF NHS platform in order to improve it, or for safety or security reasons.
We will notify you before making any material changes to these terms, unless the changes need to be implemented quickly for security, legal or regulatory reasons, in which case we will notify you of the changes as soon as we can.
If you continue to use the BMF NHS platform following any change to these Terms, you agree that this constitutes your acceptance of the amended Terms. The most up to date Terms will always be available on the BMF NHS platform from the effective date of those updated Terms.
